iv. Representation and Fraud – It is not necessary to hire a lawyer if you want to apply for Permanent Residence, Study Visa or Work Permit for Canada. The system is designed in such a way that it can be done by individuals themselves. Still many people seek advice and hire lawyers for smooth transition of their Canada Immigration Visa. In certain cases, such as the improper refusal of an application or unreasonable delays in processing, an individual may consider making an appeal to the Federal Court or Immigration Appeals Division. In such a situation, it may be wise to consult an authorized immigration lawyer or consultant.
Before hiring a consultant or lawyer, you need to verify the individual or firm whether he is authorized by the relevant authority. You need to verify whether your immigration lawyer or immigration consultant is a member of the Immigration Consultants of Canada Regulatory Council (ICCRC). Also Lawyers or notaries must be a member of a Canadian provincial or territorial law society, or the Chambre des notaires du Québec.
In Ontario, paralegals must be members of the Law Society of Upper Canada.
Beware of the Fraudulent Job Offers in the market – Any Immigrant requires to show a valid Job Offer if he is directly applying for Provincial Nominee Programs (PNPs) or Express Entry Pools. There are a lot of scammers in the market providing fake Job offer resulting in your rejection of Canada Immigration Application.
To save yourself from such fraud, an individual must first verify his/her Job Offer.
To verify the Job Offer you need to do some research on the Company from where you received the Job Offer. You can even verify the email address from where you received the Job Offer, generally the genuine recruiters use corporate email address, if you haven’t received mail from a corporate email address it may be a scam.
If the recruiters or employer ask for money upfront saying it is our joining fee or training fee or money to cover costs for work permit or visa fee, it may be a scam. Canadian companies very rarely hire without an interview, either in person or by phone. If you have only communicated by email with a potential employer who does not want to meet face-to-face or speak over the phone, it is likely a fraudulent offer. If an offer seems too good to be true, it probably is. Common scams include the promise of permanent immigration, free travel, or highly-paid work-from-home schemes. Individuals who receive a job offer that seems fraudulent are encouraged to directly contact the company named on the job offer to verify its authenticity. Alternatively, it is also possible to consult an authorized representative regarding potentially fraudulent job offers.
